Paris recognizes the right to compensation for babies under age of 2 years

Nice victory of our law firm in front of the former Tribunal d’Instance of Paris: After months of pedagogy and legal battle, a first jurisdiction in France has just recognized the right of children under the age of 2 to be entitled to compensation under the European Regulation 261/2004.

In our opinion, there is no reason not to, except to exclude the weakest passengers from any form of assistance.

This is, however, what is regularly supported by the airlines.

Through a truncated reading of the Regulation, airlines support the absence of a right to compensation for children under the age of 2.

This decision is now final and could well set a precedent.

This matter is also before the Court of Cassation, at the initiative of our law firm, and we are impatiently awaiting the decision that will be handed down by the highest French court.
